HHS Strengthens HIPAA Enforcement

HIPAA enforcement is a keystone of the HITECH Act and ambulance services can expect increasing scrutiny in the coming years regarding HIPAA compliance. This interim final rule, along with the recent breach notification regulations, are the first of several waves of new HIPAA regulations that are coming.




HHS Issues Interim Final Breach Notification Regulations

On Aug. 24, 2009, the “Breach Notification for Unsecured Protected Health Information” was published in the Federal Register. The new regulations require HIPAA covered entities, such as ambulance service providers, to notify individuals when their unsecured health information has been breached.

Stimulus Bill To Amend HIPAA Regulations

The American Recovery and Reinvestment Act of 2009 (H.R. 1), which includes significant changes for HIPAA covered entities and other organizations who perform services on behalf of covered entities and business associates was signed into law on February 17, 2009. A portion of the Recovery Act calls for computerizing all health records by the year 2014 and privacy advocates have lobbied for more stringent privacy and security measures to protect this data. This means that new regulatory requirements are on the horizon.
