OIG Approves Subsidy from Hospital to Ambulance Cooperative for Taking over the Provision of ALS Service - Issued August 18, 2009

In Advisory Opinion 09-13, the Office of the Inspector General (OIG) stated that it would allow parties to engage in an arrangement where a Hospital would pay a local Ambulance Cooperative a subsidy (cash, equipment, and services) to take over the provision of advanced life support (ALS) services that the Hospital was currently providing.

Recent Court Case Illustrates Importance of Following Patient Refusal Guidelines

A recent federal court case illustrates the importance of having - and following - patient refusal guidelines. This case - Green v. City of New York - shows what can happen when a competent patient attempts to refuse EMS transport but the crew overrides the patient's wishes and transports the patient anyway. The U.S. Court of Appeals for the Second Circuit ruled in this case that where the patient was competent but unable to speak due to a degenerative neurological condition, the refusal of the EMS crew to follow the patient's wishes could constitute a violation of the Americans With Disabilities Act (ADA).
