 The federal government estimates that nearly 2,000,000 Americans could be hospitalized in this winter’s H1N1 influenza pandemic, with estimated death rates now at three times the standard flu mortality rate. Is your EMS agency ready to deal with the tough legal issues that may arise during an H1N1 flu outbreak?  For instance, can you require employees to get flu shots? Are you obligated to provide time off for employees to care for sick family members?  What if you require your personnel to be on call during an outbreak - are you required to pay them for their on-call time? What should you do to minimize the impact of an outbreak on your own workplace? 
 
An H1N1 outbreak will impact your EMS organization just as it would any other employer. But unlike traditional businesses, demand for EMS could go up astronomically during an outbreak, and the impact of this call volume increase may challenge your workforce way beyond the norm. You have to keep ambulances on the street with healthy field providers. And if you now have problems with maintaining adequate staffing just for the normal EMS response, imagine doing it with a sudden spike in call volume while at the same time your people are calling off sick.
